Drawing on recent legal and regulatory changes, this presentation will examine the evolving landscape of ESOP litigation and whether new DOL leadership will shift enforcement priorities toward private plaintiffs. We will explore key recent issues including common interest agreements, clawbacks, and trends in claims related to mature ESOPs. The discussion will also cover significant recent court decisions and legal victories that provide new insights for appraisers and ESOP fiduciaries. Finally, an ESOP litigator will share his perspective on how appraisers can improve their work to better anticipate challenges and withstand litigation scrutiny.
